债务追讨：帮助您追回欠款，保护您的财务利益

当债务产生但未能及时偿还时，债权人可能会面临资金无法追回的问题。在澳大利亚的法律体系下，仅仅依靠协议、借条或贷款协议等形式并不足以自动实现债务的追讨。债权人若希望追讨债务，需要通过法律程序获取具有执行力的判决，并通过强制执行程序追回债款。

律师函

在正式诉讼之前，债权人通常会尝试以和解的方式解决问题。最常见的方式是向债务人发送律师函（Letter of Demand），要求债务人在规定期限内偿还欠款。如果债务人在收到律师函后同意还款，双方可以通过协商达成还款方案，并签订解决契约（Settlement Deed）。

一封正式的律师函有时能够有效地敦促债务人积极履行还款义务，但是债务人可以选择置之不理，因此发送律师函并不能保证一定能够追回欠款。

诉讼程序

如果律师函未能奏效，债权人可以选择通过法院提起诉讼。

债权人可委托律师准备并提交起诉状（Statement of Claim），详细列明索赔的依据和金额。起诉状需送达债务人，债务人通常有28天的时间提交答辩状（Defence）。若债务人未按期提交，债权人可以申请缺席判决，从而快速获得胜诉判决。
在法庭审理中，双方需要提交证据支持各自的主张。经过证据交换和听证后，法官将基于案件事实作出判决。

判决后的执行

取得判决后，如果债务人仍拒不履行判决，债权人需要向法院申请执行判决。具体执行方式包括：

债权人可申请治安官查封、扣押并拍卖债务人的财产（Writ for the Levy of Property），用以偿还欠款。
债权人可申请法院的扣押令（Garnishee Order），从债务人的银行账户或工资中直接扣除款项以偿还债务。
债权人可向法院申请，要求债务人提供财务状况的详细信息。如果债务人拒不配合，可以申请更强制性的财务调查令（Examination Order）。
若债务人符合条件，债权人可以申请宣告债务人破产。
