Australian notaries are officially appointed by the Supreme Court. They have the legal authority to confirm the authenticity and legality of facts, as well as to approve and certify domestic and international documents. Notaries are qualified senior lawyers. Although all notaries are legal practitioners, not all lawyers are notaries.

Notaries confirm the authenticity and legality of documents or witness the authenticity of signatures based on various applications from the parties. After verification, they issue a notary certificate to validate the documents in countries or regions outside Australia. Notarisation is limited to proving the authenticity of facts or the source of documents (such as the authenticity of signatures and seals) and does not cover the content of the documents or express any opinions. It is essentially a formal notarisation.

  • A Notary Public verifies and certifies documents by issuing a Notary Certificate.
  • If required, the document is sent to the Department of Foreign Affairs and Trade (DFAT) for Apostille certification, ensuring recognition in Hague Convention countries.

Typically, original documents, identification (e.g., passport), and company details (including Director’s ID) are required for corporate documents.

Yes, you must be present to sign documents such as powers of attorney and affidavits to verify your identity.

Notarisation is usually completed within 30 minutes.

However, if your document requires third-party verification, such as academic records requiring confirmation from the issuing institution or an Infotrack search, the process may take longer until verification is complete.

If Apostille certification is also required, it may take around 7 days.

No, an Apostille is typically required for documents to be recognised in China, ensuring legal validity under international law.

The Apostille is issued by the Department of Foreign Affairs and Trade (DFAT) and confirms the authenticity of notarised documents for use in Hague Convention countries, including China. Apostille certification must be completed after notarisation.

We provide a one-stop notary service, which means once notarisation is completed, we can submit your documents to DFAT for Apostille certification on your behalf. Alternatively, you may choose to submit them yourself.

Once issued, the Apostille certificate can be verified online through DFAT’s verification portal: Verify Apostille Certificate.

If your document is intended for use in China, we can assist in arranging an accredited NAATI translator to translate the content into Chinese before notarisation. We can then notarise both the original document and its NAATI translation.

However, Australian Notaries can only issue certificates in English, as it is the official language of Australia. Likewise, the Apostille Certificate issued by DFAT is also in English.

Since translation occurs before notarisation and Apostille certification, the notarised documents and Apostille certificate will be in English. If you require a Chinese version of these certificates, you may need to arrange a full document translation by an authorised translation agency in China after the notarisation process is complete.

Yes, documents with an Apostille can be used in all Hague Convention member countries. However, if the destination country is not a Hague member, the document must go through legalisation, which varies by country.

In such cases, it is recommended to check with the relevant authorities in the destination country to confirm the required steps. For example, the process may involve:

  • Notarisation by a Notary Public
  • Legalisation certification by DFAT
  • Further authentication at the destination country’s embassy or consulate in Australia
